Folks, I've sent this to all of you because it is probably the single most important statement I've ever read (see below). For those of you who are unfamiliar with legal nomenclature, I will explain the case sited below.
Chisom is the name of the plaintiff (the one who filed the complaint) and Georgia is the defendant. In this case, it is the State of Georgia. 2 US (Dall) refers to 'volume 2' of the U.S. reports of Supreme Court cases. It used to be Dall's Reports. Dall was simply the name of the guy who kept the court's records during that court session. 419 is the page in 'volume 2' where you will find the case cited. 1794 is the year the case was decided. (This means the legal profession has known about this principle for at least 200 years. It actually can be traced back to the dawn of civilization. Where do you think the Supreme Court judges got it?)
This is a statement from the U.S. Supreme Court Justices' final decision in the case. Folks, this is about as clear as it gets. It means no law made by man has any effect over you until you agree to it. To help you understand this, I will give you an example of nature's laws. Nature's law says that you can do anything you want so long as you do not interfere with the freedom of other's to do what they want. For example, if you steal, you have harmed someone. Harming people is not okay. However, if you drive fast on the highway but have no wreck and safely arrive at your destination, no one is harmed. Thus, stealing is prohibited by natural law and speeding is prohibited by man's law.
So here's the rule: If there is a victim, you have violated natures law and can be punished without your permission. If you violate man's law, you can be punished only if you agreed to the law sometime prior to violating it.
The trick is to recognize when you are agreeing to man's laws. What I have just explained in these few sentences is the core of the frustration many people are having with the legal system in America. Hint: Agreement equals contract. i.e. must be entered into freely with full disclosure of all obligations.
